SEAFORD, N.Y. (AP) — Police say a man who stole painkillers and money from a pharmacy and an off-duty federal law enforcement agent responding to the robbery in suburban New York were fatally shot.

The off-duty Arms, Tobacco and Firearms agent died Saturday after being taken to a hospital with a gunshot wound. He was not immediately identified.

Nassau County police Lt. Kevin Smith says the unidentified agent, an off-duty city police officer and a retired NCPD officer responded to the robbery at the pharmacy in Seaford at about 2 p.m.

Shots rang out when the three converged on the store as the unidentified suspect was leaving. The man was struck by gunfire and died on the spot. The ATF agent also was wounded.

Smith says the shooting is under investigation.
