Homosexual Men Charged in Torture Death of 13-Year-Old

(CNSNews.com) - In a case that has gone largely unreported by national media, Arkansas authorities are seeking the death penalty for two homosexual men charged with raping and torturing a 13-year old boy.
Davis Don Carpenter, 38, and Joshua Macave Brown, 22, each are charged with one count of capital murder and six counts of rape stemming from the September 26 death of 13-year-old Jesse Dirkhising. The accused, who pleaded not guilty, were ordered held without bond.
Prosecutors told CNSNews.com they will seek the death penalty.
The 13-year-old knew Carpenter from work he did at a hair salon in Rogers, Ark., according to court records. Carpenter also knew the boy's mother and stepfather, his grandmother, Paula McVey, testified.
The boy was found close to death at the apartment of the two men, who police described as homosexual lovers.
According to the affidavit, Brown told police that on the morning of September 26, he sneaked up on the boy, tied his hands behind his back, placed his pair of undershorts in the teen's mouth and secured the briefs with a bandana and duct tape. He said he blindfolded the youth, bound him to a bed and repeatedly sodomized him while Carpenter watched.
Investigators said they found notes from Carpenter to Brown, instructing him how to bind and sedate a child. A preliminary autopsy showed that the boy died from positional asphyxiation. Police say the boy was sodomized with several objects.
The next court appearance for the accused is Dec. 8. They are tentatively scheduled to go on trial April 10, 2000.
