Judge makes recommendation in Ala. police lawsuit
BIRMINGHAM, Ala. (AP) — A federal judge has recommended that the city of Birmingham, its police chief and four police supervisors be dismissed from an excessive force lawsuit by a man whose beating by authorities was caught on a dashboard video.
The Birmingham News (http://bit.ly/r7t2Uz ) reports U.S. Magistrate Judge Robert Armstrong made the recommendation regarding the city and Police Chief A.C. Roper on Thursday. He previously recommended that four police supervisors — Dexter Cunningham, Frank Majors, Gary Finley and Jamal McCaskey — should be dismissed from the lawsuit.
A district court judge is expected to consider Anthony Warren's objections to the recommendations. Warren sued in 2009, after video of the January 2008 beating surfaced.
His attorney, Wendy Brooks Crew, says a trial is still expected to go forward on remaining claims against six officers.
